Regularization of officiating JTOs reg:-
Sir,
Regularization of about 1500 officiating
JTOs has been one of the long pending issues raised by this Association. This
Association suggested various options, including one time upgradation of posts,
creation of supernumerary posts etc. to resolve the issue. About 3500 JTOs have
so far been regularized by diverting equal number of posts from direct
recruitment quota of JTOs.
Since 2004, SNEA(I) has been demanding
regularization of all the officiating JTOs by upgradation of posts as a onetime
measure in order to avoid litigations. But management continued diversion of
posts to regularize officiating JTOs. Diversion of posts from DR quota and non
conduction of LICE for the 35% and 15% quota was challenged in Hon Chandigarh
court resulting in prolonged litigations.
However, recently the contempt petition at
Hon High Court of Chandigarh was dropped since the LICE for rect to JTO cadre
under 35% and 15% quota was held by BSNL, and, as of now, there is no legal
hurdle in resolving the issue. As per the direction of Hon Ernakulam HC, LICE
for JTO rect under 35% and 15% quota was held on 02.06.2013. About 25% of the
officiating JTOs also appeared in the LICE held on 02.06.2013. So, the number of
offtg JTOs to be regularized will come down further once the LICE results are declared
by the Circles. Since the LICE for JTO rect is already held, the regularization
of remaining officiating JTOs will not create any seniority issue in the
future. In all the Circles, hundreds of JTO posts are vacant since no rect
against 50% dept quota was done since 2000. As such regularization of offtg
JTOs will not make any impact on the promotional avenues of internal candidates
like TTAs, Sr TOAs etc towards the 35% and 15% quota.
Considering all the above facts, the
regularization of the remaining officiating JTOs may be considered
sympathetically as all of them are officiating in the JTO cadre for so many
years. This can be easily done by onetime upgradation/creation of supernumerary
posts.
